Children in Care - Good Cause Deferral/Waiver
Administrative Rule R495-879-5 allows the Good Cause Deferral/Waiver request (DHS Form 602) to be used as criteria to deviate from the child support guidelines. This form should be completed by the Division or Institution who has custody of the child or who is providing services to the child on behalf of the parent(s). Generally, this will be the case manager or someone working closely with the child and the parent(s).
The waiver may only be submitted after the following occur:
- ORS/CIC has determined the support amount and established a support order; and,
- The Good Cause Deferral/Waiver request must include all the required signatures.
NOTE: ORS/CIC will return requests to the custodial agency that are submitted without the required signatures or submitted prior to the determination of the support amount.
You may refer to ORS/CIC policy CIC 088 Good Cause Deferral/Waiver for CIC Cases for information regarding deferral/waiver types, criteria, and procedures.
